The exact fines, according to the law (Art. 23-24 LTU)
- Being without a residence permit: up to 3 months of detention or a fine of up to fl. 1,000.
- Staying after your permit expired: up to 1 month of detention or a fine of up to fl. 500.
- Giving FALSE information to obtain or keep a permit: up to 1 YEAR IN PRISON -- this is no longer a minor infraction, it's a serious offense. It explains why case law treats any false document so severely.
The most expensive mistake: thinking "nothing happens" as long as you're not caught
A permit can be revoked for giving false information even if it's discovered many years later -- real case law cites cases up to 12 years later. It's not that "enough time passed and it was forgotten": the legal risk doesn't disappear just because nobody has noticed yet.
What if I'm detained? The real odds, not an opinion
Of 176 real court rulings fully analyzed on this site:
- Detention (bewaring): the foreign national won in 7 of 15 cases (47%) -- the highest rate of all the categories analyzed, but it's still litigation, not a guarantee.
- Expulsion/deportation: the foreign national won in 4 of 16 cases (25%).
- Protection/asylum (Art. 3 ECHR): 11 of 18 cases (61%) -- the category with the best outcome, but it requires a real, proven risk in your home country, not just any reason.
These figures are from people who ALREADY went to court, almost always because something went wrong -- they are not the probability of someone who resolves their situation the right way from the start.
The only real way out today, and its exact limit
Rib'e Lugá is the regularization path, but it requires having entered before November 13, 2025 and still being in Curaçao. It applies even if you already have an expulsion order against you, and it covers work, your own business, or family reunification -- but NOT rentier, investor, or student status. Registration closes on October 31, 2026. If you entered after Nov 13, 2025, this specific door does not apply to your case.
