• Adult Dutch nationals and their family members (as long as they hold Dutch nationality)
• US citizens (treated the same as Dutch nationals since the Joint Court ruling of December 15, 2014, Dutch-American Friendship Treaty)
• Professional diplomatic/consular staff and military personnel stationed in Curaçao, and their family members (under Art. 3 letter G of the LTU)

1. 1. Check which category you fall under (special/diplomatic-military, Dutch, or American under the DAFT treaty).

   Cómo escanear tus documentos correctamente

   El escáner (o foto) de cada documento debe cumplir TODOS estos criterios o el sistema puede rechazar tu solicitud: (1) debe ser una versión escaneada de un documento ORIGINAL, no una copia de una copia; (2) escaneado lo más derecho posible, sin inclinación; (3) sin grapas, clips, ni dedos visibles en la imagen; (4) no debe estar editado ni retocado; (5) evita dobleces y arrugas; (6) todos los datos deben verse nítidos, legibles y sin borrosidad; (7) ningún dato tachado, cubierto o corrector encima; (8) para identificaciones: la imagen debe mostrar el documento COMPLETO y a color (pasaporte: página superior e inferior; cédula: frente y reverso); (9) deja aproximadamente 2 cm de margen alrededor de la imagen; (10) el documento NO debe tener fondos translúcidos/transparentes detrás.

   • Usa un scanner de verdad si tienes acceso a uno (oficina, biblioteca, copiadora) -- da mejores resultados que una foto de celular.
   • Si usas el celular, hazlo con buena luz natural, sin flash directo, documento sobre una superficie plana y oscura para que los bordes se vean bien.
   • Guarda cada documento como PDF (no JPG suelto) cuando el trámite lo pida explícitamente en formato PDF.
3. 3. Submit the application online.

   Cómo enviar tu solicitud en línea

   La gran mayoría de trámites de la Toelatingsorganisatie se envían por CORREO ELECTRÓNICO a intake@immigrationcur.org (algunos trámites de objeción/apelación van a info@immigrationcur.org -- revisa cuál te corresponde en tu ficha). Adjunta TODOS los documentos ya escaneados según los criterios oficiales, más el comprobante de pago. Si presenta la solicitud un apoderado (no tú mismo), debe adjuntar también una autorización firmada y una copia de su identificación. Vas a recibir una confirmación de recepción por el mismo correo -- guárdala como comprobante. Rib'e Lugá es la EXCEPCIÓN: ese trámite se hace en el portal www.ribeluga.cw, no por correo.

   • Escribe un asunto claro en el correo (ej. 'Solicitud VTTV - [tu nombre completo]') para que se procese más rápido.
   • Adjunta los archivos con nombres descriptivos (ej. 'pasaporte.pdf', 'acta_nacimiento.pdf') en vez de nombres genéricos tipo 'scan001.pdf'.
   • Guarda copia de todo lo que envíes -- lo necesitarás si tienes que objetar una decisión negativa despues.
4. 4. Wait for the decision (4 months).

   Qué hacer mientras esperas la decisión

   El plazo estándar es de 4 meses desde que envías la solicitud COMPLETA (el reloj no corre si falta algo). Si es tu PRIMERA solicitud de la mayoría de los trámites, debes esperar la decisión FUERA de Curazao (excepto renovaciones/cambios, que sí se pueden esperar dentro). La decisión se envía por correo electrónico a la dirección que diste en el formulario -- revisa also tu carpeta de spam. Puedes consultar el estado de tu trámite en cualquier momento (ver la ficha 'Estado de tu solicitud').

   • Si te mudas o cambias de correo mientras esperas, avisa de inmediato a info@immigrationcur.org -- si no te localizan, pueden negar tu trámite por 'no colaborar'.
   • No compres pasajes de regreso definitivos hasta tener la decisión en mano si tu plan depende de que te aprueben.
5. 5. If positive, schedule an appointment to collect the permit. If negative, 6 weeks to object.

   Cómo objetar una decisión negativa

   Tienes 6 SEMANAS desde que te notifican la decisión para presentar tu objeción (bezwaar), por correo a info@immigrationcur.org. Tu escrito debe incluir: tu nombre completo y domicilio, una descripción clara de qué decisión impugnas, por qué no estás de acuerdo, qué resolución quieres, tu firma, y una dirección en Curazao si vives fuera. Adjunta copia de la decisión y cualquier evidencia nueva. Si rechazan tu objeción (o prefieres saltarte este paso), puedes apelar directamente ante el Gerecht en Eerste Aanleg de Curazao -- ver la ficha 'Objeción y Apelación' para el detalle completo, incluida la estrategia legal de pedir una 'medida cautelar' si no quieres esperar fuera del país.

   • No dejes pasar las 6 semanas -- después de ese plazo pierdes el derecho a objetar por esta vía.
   • Si tu objeción es contra el rechazo de una RENOVACIÓN, por defecto tienes que esperar fuera del país igual que en una primera solicitud -- a menos que le pidas EXPLÍCITAMENTE al juez una medida cautelar (voorlopige voorziening).

  Formulario 910. Es la orden de pago que usas en el banco Maduro & Curiel's (MCB) para pagar las tarifas del trámite ANTES de enviar tu solicitud. Es solo una casilla que marcas según tu trámite -- el monto ya viene fijo, no lo calculas tú.

⚠️ Important notes

• The Van Rechtswege (VRW) is NOT the same as the 'Verklaring Niet van Toepassing' (NVT): only Dutch nationals BORN in Curaçao/the Antilles (or their children) have automatic access to the NVT. A European Dutch national, even after years of residing on the island, remains under VRW (ECLI:NL:OGEAC:2023:220).
• The 'by operation of law' route for providing services to the government (art. 3-G LTU) only applies to SPECIALIZED personnel that is hard to find locally (doctors, teachers); it does NOT cover unskilled work such as cleaning, even for a government body (ECLI:NL:OGHACMB:2025:263).
• Dutch nationals (and by extension, Americans via DAFT) have 6 FREE MONTHS in Curaçao WITHOUT needing to process any Van Rechtswege declaration -- they already have automatic admission by operation of law during that time. You only need to process it if: (a) you want to WORK within those 6 months, or (b) the 6 months have already passed. It is your responsibility to keep track -- the government does not notify you when the time is up.
• Additional category not previously documented: anyone BORN IN CURAÇAO (regardless of nationality) admitted uninterruptedly since birth and who is already 16 years old, obtains automatic admission by operation of law. This is lost after 3+ continuous years outside Curaçao (except for study/medical treatment, returning within 1 year of finishing it). (Art. 3-i, 4, 5b LTU)
• Anyone with Van Rechtswege admission is EXEMPT from the security deposit (waarborgsom) -- an exemption not mentioned on the deposit page. Also exempt: minor children of a woman born in Curaçao with Dutch nationality before marrying, and children born in Curaçao with a parent who has been a legal resident for 10+ continuous years. (Art. 11(2) LTU)
• 'Definitive departure' for someone with Van Rechtswege occurs if you move permanently outside Curaçao, or if you settle outside for MORE THAN 3 YEARS (having been established in Curaçao for at least 3 years before). The declaration is automatically voided, you must deregister with Immigration, and if you return afterward you must apply for a new declaration from scratch. (Section 3.6, 2016 policy)
