Adjunta TODOS los documentos ya escaneados según los criterios oficiales, más el comprobante de pago. Cómo objetar una decisión negativa
Tienes 6 SEMANAS desde que te notifican la decisión para presentar tu objeción (bezwaar), por correo a info@immigrationcur.org. Tu escrito debe incluir: tu nombre completo y domicilio, una descripción clara de qué decisión impugnas, por qué no estás de acuerdo, qué resolución quieres, tu firma, y una dirección en Curazao si vives fuera. Es el formulario maestro: se usa para primera solicitud, renovación o cambio de CASI cualquier permiso de residencia (trabajo, familia, estudio, rentista, inversionista, empresa propia). Tiene 13 secciones numeradas. Solo llenas las secciones que aplican a tu caso -- las demás se dejan en blanco o 'n.a.'
Section 1 — Motivo de la solicitud: Marca UNA sola casilla: primera solicitud, renovación, o cambio (cambio solo si ya tenías un permiso vigente antes).
Section 2 — Meta de tu estadía: Marca el motivo PRINCIPAL de tu solicitud (Trabajador, Director, Reunificación familiar, Prácticas, Estudio, Empresa individual, Arreglo pensionado, Rentista/Pensionado). Si tienes más de un motivo, elige el más importante -- el resto de requisitos de tu trámite específico dependen de esta casilla.

Section 4 — Datos personales del extranjero (el solicitante): Tus datos completos: apellidos, nombres, fecha y lugar de nacimiento, nacionalidad(es), número FMSCRV (solo si ya tuviste un permiso antes), dirección en el extranjero Y en Curazao, teléfono, correo (a ese correo llega la decisión), datos de pasaporte, y estado civil (casado/divorciado con fechas).

Section 7 — Información laboral / fuentes de ingresos: Nombre del empleador, tu función/cargo, tus ingresos (indicando si es por semana/quincena/mes/año), y tu número CRIB personal.
Section 8 — Información del garante: El 'garante' es quien responde por tu estadía: tu empleador (persona u organización) o quien te reunifica con tu familia. Si es una persona: nombre, nacimiento, dirección, CRIB. Si es una organización/empresa: nombre de la empresa, dirección, número de Cámara de Comercio (KVK), persona de contacto, CRIB de la empresa.
Section 9 — Preguntas sobre tu estadía en Curazao: Desde cuándo estás en Curazao y cuándo planeas establecerte. ADVERTENCIA TEXTUAL DEL PROPIO FORMULARIO: si respondes que ya estás en Curazao SIN un título de residencia válido, el formulario mismo te avisa que 'esto puede ser motivo para negar tu petición'. Piensa bien esta respuesta y busca asesoría si tu situación es irregular.
Section 10 — Fecha de vencimiento del permiso actual: Solo llenar si es renovación o cambio -- la fecha exacta en que vence tu permiso vigente.
Section 11 — Justifica tu solicitud: Espacio libre para explicar tu caso en tus propias palabras. Si necesitas más espacio, agrega una página en blanco. Aquí puedes mencionar circunstancias especiales (ej. condición médica de un hijo, arraigo familiar largo, etc.) que la jurisprudencia muestra que el gobierno debe considerar explícitamente.
Section 12 — Declaración de antecedentes: Declaración jurada de que nunca has tenido condena penal, trabajo comunitario obligatorio, multa penal incondicional, ni proceso penal en curso. Si NO puedes declarar esto con la verdad, hay un espacio para explicar por qué -- NO mientas aquí: ocultar antecedentes es motivo de rechazo autónomo confirmado por jurisprudencia real (más grave que declarar el antecedente honestamente).

Section 1 — Información del garante: Apellidos, nombres, género, dirección (si el garante es una empresa, la dirección de establecimiento), número de identificación, fecha y lugar de nacimiento, nacionalidad y teléfono. Si el garante es el empleador (empresa), se coloca el nombre de la empresa y los datos personales y la firma deben ser del director o de un representante autorizado.
Section 2 — Compromiso de garantía: Texto fijo (no se llena): el garante declara que cubrirá los gastos para el Estado y otras entidades públicas derivados de la estancia LEGAL O ILEGAL del extranjero, incluyendo el costo de un viaje de deportación/salida a un país que lo reciba. La firma el empleador confirmando los términos reales del contrato de trabajo del extranjero: tipo de contrato, horario y salario. Es la prueba de que el empleo es real y verificable, no solo declarado.
Section 1 — Información del empleado: Apellidos, nombres, género, dirección, número de ID, fecha y país de nacimiento, nacionalidad -- datos del trabajador extranjero.
Section 2 — Información del empleador: Nombre de la empresa, dirección, teléfono y número CRIB de la empresa.
Section 3 — Detalles del empleo: Función/cargo del empleado, fecha de contratación, si el empleo es permanente o a plazo fijo (con fecha de término si aplica), si hay período de prueba (y hasta cuándo), horas semanales CONTRACTUALES y horas semanales REALES (se piden ambas por separado -- deben coincidir con la realidad), salario bruto y neto (excluyendo bono vacacional) por mes o por semana, y si hay bono vacacional (con el % o 'No').

🏆 Recommended strategy (based on won cases)
Case law pulls in two opposite directions, and you need to know which one applies to you. In your favor: the work permit is the LEGAL responsibility of the employer, not yours -- if it was never processed because the employer failed to do so, that cannot be held against you without a prior express warning (ECLI:NL:OGHACMB:2022:157 and 158, both won). Against you: if Immigration ever formally notified you of a departure order (even one of just 6 weeks) and you did not comply with it, that alone counts as a 'violation of public order' and blocks future permits, no matter how well everything else in your case goes (ECLI:NL:OGHACMB:2024:86).
- 1. First check whether you ever received a FORMAL notification from Immigration asking you to leave the country. If there never was one, your case is defensible. If there was one and you did not leave, your situation is much weaker -- get legal advice before submitting any application.
- 2. Have the employer initiate the work permit (tewerkstellingsvergunning) with the Ministry of Labor (SOAW) first -- it is their legal obligation, not yours.
- 3. Accept that the FIRST residence application must be awaited outside Curaçao. No favorable informal note from an official exempts you from this (ECLI:NL:OGEAC:2019:308) -- do not rely on verbal promises.
- 4. If you have a criminal record, even a minor fine can be enough to deny a renewal on 'public order' grounds (ECLI:NL:OGHACMB:2020:103) -- be transparent about this from the start; hiding it is worse (ECLI:NL:OGHACMB:2024:23).
Main risk: Disobeying a prior departure order. This is the factor that weighs most heavily against you, more than the employer's good will or the strength of the rest of the case.
⚠️ Important notes
- EVIDENCE-BASED VERDICT: of 5 real cases dealing specifically with the requirement to wait for the decision outside the country (uitlandigheidsvereiste) for someone already in Curaçao, 4 out of 5 LOST (ECLI:NL:OGEAC:2019:308, ECLI:NL:OGEAC:2021:126, ECLI:NL:OGHACMB:2022:48, ECLI:NL:OGHACMB:2024:22). The only one won (ECLI:NL:OGHACMB:2021:12) was due to a specific wording ambiguity in the DIRECTOR category, not applicable to employees. The only way the government has historically exempted someone from this requirement is through a SPECIAL REGULARIZATION POLICY with a cutoff date (Integrashon Responsabel 2021 -> Ribe Luga 2026) -- never by litigating an individual case. If you do not qualify for the special policy currently in effect based on your entry date, there is no reliable legal shortcut to avoid leaving the country.
- The residence permit for work is legally dependent on first having the Ministry of Labor's work permit approved; if that is denied, the residence permit is automatically denied as well (ECLI:NL:OGHACMB:2021:279).
- Changing employer or situation (e.g., finishing your studies and starting to work) gives you 6 weeks to notify the authorities and adjust the procedure.
- Any relevant change in personal circumstances (divorce, end of studies, dismissal) must be reported to Immigration within 6 weeks, or you retroactively lose your accumulated legal residence time (ECLI:NL:OGHACMB:2023:206).
- A criminal record, even a minor fine, can be enough to deny a renewal on 'public order' grounds — a serious offense is not required (ECLI:NL:OGHACMB:2020:103). A serious conviction (more than 3 months' imprisonment) can revoke even a permanent permit already obtained (ECLI:NL:OGHACMB:2026:71).
- Submitting even a single false document (e.g., a declaration from an employer that does not exist) taints the credibility of the entire application (ECLI:NL:OGHACMB:2023:208).
- The Employer's Declaration your boss must fill out asks for CONTRACTUAL weekly hours and ACTUAL weekly hours separately (to detect discrepancies between what was agreed and what was actually worked), in addition to gross/net salary and vacation bonus percentage, and it requires the company's PHYSICAL STAMP alongside the signature -- without the stamp, the form can be rejected as incomplete.
- Whoever signs the Guarantee Declaration (the employer or guarantor) is legally liable to the State for any costs generated by your stay -- LEGAL OR ILLEGAL -- including the cost of a possible deportation/forced departure trip. If the guarantor is married, their spouse must also sign the declaration.
- Exact legal basis of the Guarantee/Employer's Declaration: the employer commits in writing to cover (a) the repatriation costs of the worker and their family, and (b) ALL expenses the government would have to bear if the worker (or their family) becomes indigent or needs hospitalization paid for by the government. The guarantor must demonstrate sufficient means to be able to fulfill this. (Art. 4(4) and 11(2)(3) Toelatingsbesluit)
- FACT NOT VERIFIED IN PRACTICE: the legal text (Toelatingsbesluit, Art. 4-1h) still requires, for domestic/cleaning staff and other unskilled work (except agricultural), a 'declaration that the person is NOT MARRIED'. This does not appear on any current website or form -- it might be obsolete in practice, but it is worth asking directly whether it applies to your case before assuming it does not.
- Key legal basis behind all the case law on permit revocation (Art. 10 LTU): 'anyone who acts against the conditions of their permit is considered to have acted WITHOUT ANY PERMIT at all' -- violating a condition is not a minor infraction; legally it puts you in the same status as having no permit at all.
- Exact criminal penalties for immigration violations (Art. 23-24 LTU): being without a permit = up to 3 months' detention or a fine of up to fl. 1,000; overstaying after the permit expires = up to 1 month or a fine of up to fl. 500; providing FALSE information to obtain or maintain a permit = up to 1 YEAR OF IMPRISONMENT (a serious offense, not a minor infraction) -- this explains why case law treats any false document so severely.
- After 5 continuous years working under a tewerkstellingsvergunning (without gaps in validity), the worker obtains a residence permit INDEPENDENT of the employer (no longer tied to 'doel arbeid' via that specific employer). Duration of subsequent extensions: first 2 years, then 3 years each time. Dependent family members receive an equivalent dependent permit. (Section 3.3.1(b) HIG 2006)
- Exact and VERY specific rules for guarantors: (1) a company/legal entity must show a profit-and-loss statement if there is doubt about whether it has sufficient capital; (2) a sole proprietor (eenmanszaak) acting as guarantor needs taxable income of at least NAf 36,000, PLUS an additional NAf 18,000 for EACH additional foreign worker they guarantee; (3) individuals with live-in domestic staff need NAf 36,000 of proven income PER PERSON they guarantee (e.g., a pair of caregivers = NAf 72,000/year); (4) an employee can NEVER be the guarantor for their own family (their income depends on the employer); (5) if the employer provides the guarantee for the worker AND the worker's family migrates together, the employer is also the guarantor for ALL of them. (Section 3.8-b.1 HIG 2006)
- The guarantor's liability does NOT end when they withdraw the guarantee in writing -- they remain liable for ALL costs (repatriation, medical care, AND IMMIGRATION DETENTION COSTS at a rate of NAf 200 per EACH 24 hours) until the foreigner actually leaves the country. If the guarantor does not pay voluntarily, the government can initiate judicial collection via bailiff/seizure. (Section 3.8-b.1 HIG 2006)
- HEALTH INSURANCE -- verified practical information: while your application is pending (without a permit yet) you CANNOT use the public system (SVB/BVZ), which is only for those who ALREADY have residency. You need temporary PRIVATE insurance with minimum coverage of US$15,000 that includes hospitalization, emergencies, and repatriation (including in case of death). The largest local insurer with a physical office in Curaçao is ENNIA (product "Ziektekosten Algemeen") -- it is the easiest option to arrange in person on the island, rather than an international insurer. Once your permit is approved, you enroll in the SVB (BVZ), the mandatory basic system for residents, and you can normally cancel the private insurance.
